These are the Terms and Conditions for using our service, which you can access from our website via your own PCs, laptops, tablets and mobile phones.
These Terms and Conditions apply wherever you access the Yanchep News Online Classified Ad section.
These Terms and Conditions – in force from August 8, 2022 – are important and you should read them carefully.
Yanchep News Online reserves the right to amend the Terms and Conditions at any time – any changes will be published in this web document.
To use the Classifieds service you must be over the age of 18.
Advertisers must be located in Australia.
Your use of and access to the Classified service indicates your acceptance of these Terms and Conditions, as they exist at the time of use.
Using the Classified ad service
You need to register at classifieds.yanchepnewsonline.com.au if you wish to place a classified listing to buy or sell a car, boat or caravan for example or to post an employment related ad (whether you are seeking or offering employment).
Do not allow anyone else to use your registration details to use the classifieds service and do not register on behalf of someone else.
On Yanchep News Online you can place a classified listing to buy or sell a wedding dress, furniture, car, boat or caravan for free.
The same free ads can only be placed once in a 30-day period.
Yanchep News Online may remove some or all of your free ads if your content and frequency of ads are considered unreasonable.
Using the Yanchep News Online Classified service to post a government department, government authority or local government notice or tender etc however requires payment.
All fees and charges quoted and charged are in Australian Dollars (AUD).
Yanchep News Online may change the fees or charges at any time by giving 14 days notice.
You agree that you will only post in relation to goods or services in Australia in the appropriate category or area.
You agree that you will not do any of the following things:
- violate any laws or the posting rules
- post any threatening, abusive, defamatory, obscene or indecent material;
- be false or misleading;
- infringe any third-party right;
- distribute or send communications that contain spam, chain letters, or pyramid schemes;
- distribute viruses or any other technologies that may harm Yanchep News Online, the Classified service or the interests or property of Yanchep News Online users;
- impose an unreasonable load on our infrastructure or interfere with the proper working of the Classified service;
- copy, modify, or distribute any other person’s content without their consent;
- use any robot spider, scraper or other automated means to access the Classified service and collect content for any purpose without our express written permission
- harvest or otherwise collect information about others, including email addresses, without their consent
- bypass measures used to prevent or restrict access to the classified service; and/or
- post an ad with the intention to profit from a natural disaster, health or public safety concern, or tragic event.
Prohibited Items
Yanchep News Online reserves the right to remove, delete or not publish any notices or advertisements which advertise prohibited content and items as per Australian law.
Items which would be in breach of any law or statute (which includes any regulation or other delegated legislation or any enforceable code of conduct or standard) or would infringe a third party’s rights are not allowed to be offered for sale in the Yanchep News Online Classified section.
Prohibited items and content include, but are not limited to:
- Items on the prohibited goods list (include link above )
- Material with links to adult content
- Illegal ticket sales – WA’s Ticket Scalping Act came into effect in September 2021, making it illegal to re‑sell a ticket to WA concerts and events for more than 110 per cent of its original price.
- Publications, films, computer games and other material where the content has either been refused classification or given an X18+ classification by the Classification Board. This includes pictures of nudity, real depictions of actual sexual activity, child pornography, depictions of bestiality, material including excessive violence or sexual violence and/or detailed instruction in crime, violence or drug use
- Publications, films, computer games and other material where the content has not been classified (for example, amateur films or images) but which, if classified, would be prohibited
- Publications, films, computer games, photographs, objects and other material which are indecent or obscene
- Material that contains advertising or ‘spam’ Material containing financial advice or recommendations regarding securities.
- Material that is defamatory, indecent, threatening, misleading or otherwise containing illegal content.
- Material that contains advertising or ‘spam’ material containing financial advice or recommendations regarding securities.
- Anything containing a virus or code designed to interrupt the website.
This agreement is governed by the laws of Western Australia, Australia and the parties submit to the jurisdiction of the courts of Western Australia.
Yanchep News Online will handle your personal information and other data in accordance with Yanchep News Online’s Privacy Policy which is available at https://www.yanchepnewsonline.com.au/privacy/

You are solely responsible for all information that you submit to Yanchep News Online via the Classified section and any consequences that may result from your notices and/or advertisements.
Yanchep News Online can at our discretion refuse, delete or take down content that we think is inappropriate or breaching these Terms of Use.
We also can at our discretion restrict a user’s usage of the Classified service either temporarily or permanently or refuse a user’s registration.
Without limiting other remedies, we may issue warnings, limit or terminate our service, remove hosted content and take technical and legal steps to keep users off the service if we think that they are creating problems or acting inconsistently with the letter or spirit of our policies.
However, whether we take any of these steps, we do not accept any liability for monitoring the service or for unauthorised or unlawful content on the service or use of the service by users.
You also accept that Yanchep News Online is not under any obligation to monitor any data or content which is submitted to or available on the service.
Limitation of Liability
Nothing in these Terms of Use excludes, restricts or modifies any rights or statutory guarantees that you may have under applicable laws that cannot be excluded, restricted or modified, including any such rights or statutory guarantees under the Australian Consumer Law.
To the extent that these Terms of Use are found to exclude, restrict or modify any such rights or statutory guarantees, those rights and/or statutory guarantees prevail to the extent of the inconsistency.
The Classified service is provided “as is” and “as available”.
You agree not to hold us responsible for things other users post or do.
As most of the content on the Classified service comes from other users, Yanchep News Online does not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what is offered.
Yanchep News Online and its employees and agents will not be liable to you or any other person for any loss, injury or damage arising from or as a consequence of any act or omission.
Under Schedule 2 of the Consumer and Competition Act 2010 (Cth) (“Australian Consumer Law”) and other state-based legislation, certain warranties and conditions (“Implied Terms”) are implied into these Terms of Use.
The operation of, and liability for breach of, the Implied Terms cannot be excluded and can only be limited in certain circumstances.
Except for the Implied Terms, Yanchep News Online excludes to the fullest extent permitted by law all terms implied by statute, at law, in fact or otherwise.
You understand and agree that Yanchep News Online has no warranty obligations or other liabilities to you under these Terms of use.
We exclude to the fullest extent permitted by law all liability for any liabilities, losses, damages, costs or expenses (whether arising in contract, tort (including negligence) or under any other cause of action) suffered or incurred by any person in connection with these Terms of Use or an act or omission of our or any of our personnel in connection with these Terms of Use except for liability for breach of the Implied Terms which cannot be excluded by law (which may be limited to the extent permitted by the Australian Consumer Law).
In addition, our liability for breach of a condition or warranty implied into these Terms of Use is limited in the case of services to the supplying of the services again or the payment of the cost of having the services supplied again.
Yanchep News Online cannot guarantee continuous or secure access to the Classified service. While we will use reasonable efforts to maintain an uninterrupted service, we cannot guarantee this and to the extent permitted by law, we do not give any promises or warranties (whether express or implied) about the availability of the service or that the service will be uninterrupted or error-free.
While Yanchep News Online does its best to ensure the optimal performance of the website, you agree that you use the website and rely on material contained on the website at your own risk.
In addition, to the extent permitted by applicable law, we (including our agents and employees) are not liable, and you agree not to hold us responsible, for any damages or losses (including, but not limited to, loss of money, goodwill or reputation, profits, other intangible losses, or any special, indirect, or consequential damages) resulting directly or indirectly from:
- the content you provide (directly or indirectly) using our Classified service;
- your use of or your inability to use our service;
- delays or disruptions in our service;
- viruses or other malicious software obtained by accessing or linking to our service;
- glitches, bugs, errors, or inaccuracies of any kind in our service;
- damage to your hardware device from the use of any service;
- the content, actions, or inactions of third parties, including items listed using our service;
- a suspension or other action taken with respect to your account for breach of these Terms of Use or our policies;
*your need to modify practices, content, or behaviour, or your loss of or inability to do business, as a result of changes to these Terms of Use or our policies.
Indemnification
You agree to indemnify and hold Yanchep News Online, related parties, employees, agents, independent contractors, advertisers, partners, and co-branders from any claim or demand, including reasonable attorney’s fees, that may be made by any third party, that is due to or arising out of your conduct or connection with this web site or service, your provision of content, your violation of these Terms and Conditions or any other violation of the rights of another person or party.
